2 A point of procedure may be noted here. A. said that he had not heard that E. took palm wine to the elders when he summoned them, and, he added, there is no need for palm wine in a case like this where the law has been broken because those called to judge know that there will be a fine which they will get. In a case like debt or of a wife leaving her husband without refunding the bride price, the injured party would take palm wine and money and go to the elders, perhaps 3s. for a big bride price case and double if people with z title are called in. This money, said A, is not a bribe ; a bribe would probably come later. The money and wine they take first is for the work they are asked to do. A. gave this account as of his own part of the country, but said he thought it would also apply to Umuεkε. I did not systematically investigate the matter, but it points to a differentiation of procedure suggestive of a distinction between criminal and civil cases.

1 An Onitsha man, at present in England, who has had considerable Native Court experience, tells me that people who have undertaken to swear will be seized with qualms and go at night to the Court Clerk to ask him somehow to get them out of it. The practice evidently has some weight still even among people sufficiently “advanced” to use the Native Courts.
